DOGE Must Face Privacy Suit Over Access to Treasury, OPM Data

A challenge to the Department of Government Efficiency’s access to Americans’ personal information survived the administration’s bid to toss the lawsuit.
The government’s arguments that the plaintiffs lacked standing has been expressly rejected by the en banc Fourth Circuit in a separate case concerning DOGE’s access to Social Security data, the US District Court for the Eastern District of Virginia said Wednesday. And the administration’s assertions that the plaintiffs failed to state a claim have been rejected by several courts handling similar cases, Judge Rossie D. Alston Jr. said.

Its great when real stuff gets proper en banc hearings and his cries for them are denied
Kinda feel like Elon Musk should be named in this lawsuit.
They should name X Æ A-Xii Musk too, then.
One because Musk needs his human shield around, and two because somebody else needs to name that kid.
So basically, Elon Musk was never the official Administrator of DOGE. It was this different woman that no one has heard of or seen.
On paper Elon Musk was only ever a “Special Government Employee”. This is an advisory or consultant type position that normally comes with no salary. It allows the politicians and political appointees to bring in their old friends from outside government, so they can talk to them. And meanwhile the friends get badges and credentials and email accounts so they can function in the office. But the bottom line is that SGE only ever has advisory power; no real power.
So that’s why Musk is not named on a lot of these suits. Anna Bower spent a lot of time trying to figure it out.
Justice has been prompt as ever. At least we trade these long case lengths for having real consequences for people in power that will dissuade future law breaking. There’s something to look forward to in a year or so other than “that thing they already did was wrong”, right?
